قواعد رفتاری حاکم بر قضات در امریکا و ایران

چکیده
یکی از عوامل اصلی بحران های اجتماعی و به ویژه اقتصادی، رسوایی های اخلاقی و مالی است. این رسوایی ها به حوزه اجتماع و اقتصاد محدود نشده و به عرصه حکمرانی و دستگاه حکومت راه می یابند. یکی از راهکارهای مؤثر در تنزل این قبیل رسوایی ها، وضع قواعد رفتاریِ ضد فساد است که با رویکردی مبتنی بر خودتنظیمی حرفه ای، توسط اعضای هر حرفه با لحاظ ویژگی های آن حرفه وضع می شوند. پرسش این است که قضاوت به عنوان حرفه ای که همواره در معرض موقعیت های فسادخیز است، تابع کدام دسته از قواعد رفتاری بوده و وضعیت شان چگونه است؟ در این ارتباط، به نظر می رسد کشوری چون امریکا به دلیل اهمیت جایگاه قضات در آن کشور، گام های مهمی برای تبیین تکالیف رفتاریِ حرفه ایِ قضات برداشته است که با عنایت به سابقه کم اسناد مختلف حاکم بر رفتار قضات در کشورمان، می تواند نصب العین متولیان این حوزه باشد. چراکه سلوک رفتاریِ قضات نقش مهمی در جایگاه قوه قضائیه، اعتماد عمومی به دستگاه قضائی، جایگاه عدالت و ... دارد. از خلال یک مطالعه توصیفی- تحلیلی درمی یابیم که مواردی چون بی طرفی، رازداری، اجتناب از فعالیت های سیاسی، محدودیت در دریافت هدایا، امتیازات و تسهیلات و ... از جمله تکالیف مهمی است که در نمونه قواعد رفتاری قضات امریکا قابل مشاهده است.Codes of Judicial Conduct in the U.S and Iran
One of the main factors of social and economic crises is moral and financial scandal. These scandals are not limited to the realm of society and economy, but enter the realm of governance and the state. One of the effective strategies to reduce such scandals is enactment of anti-corruption codes of conduct which are enacted by the members of each profession according to the characteristic of that profession with an approach based on Professional Self-Regulation. The question is, which sets of codes of conduct governs judgment as a profession that is always exposed to corrupt situation and how are their status? In this regard, the U.S due to the importance of the position judges in it, has taken significant steps to explain professional behavioral duties of judges that due to the poor history of documents governing the conduct of Iranian judges, can be considered by the relevant authorities. Because of behavior of judges plays an important role in the position of the Judiciary, public trust in judicial branch, position of justice and so on. Through a descriptive-analytical study, we find that items such as Impartiality, Confidentiality, avoidance of political activities, restriction on the receipt of gifts, favors and loan, etc. are important duties that exist in the American codes of judicial conduct.
