چکیده
قانون مفهوم کلیدی مشروطیت ایران است. ایرانیان از آغاز دوران جدید تاریخ خود به اهمیت این مفهوم پی بردند. به باور آنها قانون راه حل مشکلات متعددی بود که در کشور وجود داشت. اندیشمندان ایرانی از دوره قاجار کوشش کرده اند که دیدگاه خود را در مورد این مفهوم و چگونگی نوشتن آن در ایران بیان کنند. در این مقاله به بررسی آرای یکی از مهمترین روشنفکران ایران در عصر قاجار در خصوص قانون پرداخته شده است. میرزا ملکم خان از نخستین ایرانیانی بود که در مورد قانون سخنان متعددی گفت و تاریخ قانون خواهی ایرانیان با نام او گره خورده است. در این مقاله کوشش شده است با روش توصیفی- تحلیلی و با تکیه بر نوشته های ملکم خان تعریف او از قانون، چگونگی وضع قانون، ویژگی های قانون و نسبت فقه با قانون مورد بررسی قرار گیرد. اگرچه سخنان او در برخی موضوعات مانند ویژگی های قانون قابل توجه است، اما حقیقت آن است که نمی توان اندیشه ای منسجم و منظم در خصوص مفهوم قانون از آرای او بیرون کشید.The concept of law in the thought of Mirza Malkam Khan
Law is the key concept of Iran's constitutionalism. Iranians realized the importance of this concept from the beginning of the new era of their history. They believed that the law was the solution to many problems in the country. Iranian thinkers from the Qajar period have tried to express their views on this concept and how to write it in Iran. In this article, the opinions of one of the most important Iranian intellectuals about the law in the Qajar era have been examined. Mirza Malkam Khan was one of the first Iranians who spoke many words about the law, and the history of Iranian law-seeking is tied to his name. In this article, an attempt has been made to analyze the definition of law, how the law is established, the characteristics of law, and the relationship between Feghh and law by relying on Malkam Khan's writings. Although his words are significant on some issues such as the characteristics of law, the truth is that it is not possible to extract a coherent and orderly thought about the concept of law from his opinions.
