چکیده
زمینه و هدف: سیاق در فقه از موضوعات محل بحث و نظر است. در این مقاله تلاش شده به بررسی آثار و کاربردهای سیاق در فقه پرداخته شود. مواد و روش ها: مقاله حاضر توصیفی تحلیلی بوده و از روش کتابخانه ای استفاده شده است. ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت داری رعایت شده است. یافته ها: یافته ها بر این امر دلالت دارد که سیاق از روش های مهم کشف معنای واژگان به خصوص در آیات قرآن است. الفاظ قرآن به تنهایی و مجزا از جملات و آیات بار معنای خاصی دارند اما همان لفظ وقتی در قالب جملات قرار می گیرد معنای خاصی پیدا می کند عدم توجه به معنای لفظ در عبارات و جملات پس و پیش مانند حذف یکی از حروف لفظ می باشد که مخل معنا می گردد. و از آن می توان به عنوان یکی از قواعد مهم در توسعه ی استنباط احکام شرعی بهره جست. نتیجه گیری: قرآن با اسلوب خاصی که دارد با کمترین لفظ بیشترین معنا را افاده می کند. چنانکه روایات نیز به دلیل انشعاب آن ها از منشأ وحیانی از این قاعده مستثنی نخواهند بود. از این روی توجه به سیاق ما را به درک معانی دیگری فراتر از الفاظ و عبارات سوق می دهد؛ چرا که سیاق استمداد از جمیع قرائن محفوف به متن جهت کشف فهم مراد متکلم است. به همین دلیل است که فقیهان و همواره در فهم و استنباط خود به آن توجه داشته و در برداشت های فقهی خود به نحو ایجابی و یا سلبی از آن مدد جسته اند.Effects and Applications of Context in Jurisprudence
Background and Aim: Context in jurisprudence is one of the topics of debate. In this paper, an attempt has been made to investigate the effects and applications of context (Siyaq) in jurisprudence. Materials and Methods: This paper applies a descriptive-analytical design using the library method. Ethical considerations: In this article, the texts’ originality of, honesty and trustworthiness have been observed. Findings: The Findings indicate that context is one of the important methods to discover the meanings of words, especially in the verses of the Qur'an. The words of the Qur'an alone and separately from the sentences and verses have a special meaning, but a same word gets a special meaning when it is placed in the form of sentences. Lack of attention to the meaning of a word in preceding and following phrases and sentences is like removing one of the letters of the word, which distorts the meaning. And it can be used as one of the important rules in the development of the inference of Sharia rulings. Conclusion: Paying attention to context leads us to understand other meanings beyond words and phrases because context is to take help from all the evidence surrounded by the text to discover the purpose of the speaker. It is for this reason that the jurists have always paid attention to it in their understanding and inference, and have sought help from it in their jurisprudential perceptions in an affirmative or privative manner.
