چکیده
بررسی شرایط شکلی ثبت اختراع در همه ادارات ثبت اختراع بوسیله کارمند اداره ثبت انجام می شود اما بررسی شرایط سه گانه ماهوی که شامل نو بودن، دارای گام ابتکاری بودن و کاربرد صنعتی داشتن می باشد به جهت ایجاد هزینه های مالی و فنی بالا، در کشورهای مختلف در دو سیستم انجام و اعلام میشود. در سیستم بررسی، شرایط ماهوی به دقت مورد بررسی قرار می گیرند و در مقابل، سیستم اعلامی، شرایط ماهوی را مفروض انگاشته، هزینه های اثبات این شرایط را به واسطه اعتراض رقبا و اشخاص ثالث به مرحله پس از ثبت منتقل می کند. با توجه به اینکه گزینش هر یک از دو سیستم مذکور، آثار فراوانی بر چهار حوزه مخترعان و سرمایه گذاران، رقبا، دولت (شامل اداره ثبت و دادگاه) و نیز جامعه گذاشته و با افزایش یا کاهش انگیزه ثبت اختراع و حضور در بازار رقابتی امروز، حیات بازار تجارت را تضمین می کند، بررسی این آثار واجد اهمیت فراوانی است.Dual system for reviewing patent conditions
