چکیده
زمینه و هدف : پژوهش حاضر دین را در تعامل با علم و هم چنین اراده انسان را تحت اراده خالق هستی، در زیستی شایسته و توأم با انس در خلقت واسعه الهی مورد شناسایی قرار داده است و در وجهی دیگر و از سوی فناورانه، برنامه فضایی آرتمیس را آغازگر حضور تأثیرگذار در فضای ماورای جو می داند. مواد و روش ها : پژوهش حاضر از نوع نظری و روش آن به صورت توصیفی-تحلیلی است و ابزار گرد آوری اطلاعات به صورت کتاب خانه ای بوده است. یافته ها : رابطه ای که یا بر بستر تعامل شکل می گیرد یا در ذات خود تفاوت را بر می گزیند یا در تقابل قرار می گیرد. از آیه سی و سوم سوره الرحمن، نفوذ و استیلای نوع بشر بر فضا و چگونگی رابطه علوم و فناوری های فضایی با دین قابل استنتاج است. ملاحظات اخلاقی : در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت داری رعایت شده است. نتیجه گیری : واکاوی چالش های پیش روی استیلای انسان بر ماه از جمله اکتشاف و استخراج از منابع طبیعی، رعایت حقوق مالکیت فکری، رعایت حقوق بشر، حفاظت از محیط زیست و میراث فرهنگی و طبیعی به این نتیجه رسیده است که تنها راه تضمین حقوق بین الملل فضایی حاکم بر ماه باور عملی به اصل میراث مشترک بشریت بودن آن است.Jurisprudential assessment of human occupation of the moon, the position of the Artemis space program and its legal challenges
Background and Aim : the present research identified religion in interaction with science and also the will of man under the will of the Creator, in a worthy life and together with man in the vast creation of God And in another aspect and from the technological side, he considers the Artemis space program to be the beginning of an effective presence in outer space. Materials and Methods : This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Findings : A relationship that is either formed on the basis of interaction or in its essence chooses the difference or is in conflict. It can be deduced from the 33rd verse of Surah Rahman, the influence and conquest of mankind on space and the relationship between space science and technology and religion. Ethical Considerations : In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion : Analyzing the challenges facing human occupation of the moon, including the discovery and extraction of natural resources, respect for intellectual property rights, respect for human rights, protection of the environment and cultural and natural heritage, has come to the conclusion that the only way to guarantee the rights of The space world ruling the moon is a practical belief in the principle that it is the common heritage of mankind.
