بررسی اصول حاکم بر قراردادهای ائتلاف پروژه در صنعت نفت و گاز از منظر استراتژیهای مقابله با ریسک

چکیده
یکی از مسائل اساسسی صنعت نفت بحث مدیریت ریسک است که با لزوم سرمایه گذاری در پروژه های پیچیده تر کنونی به یک چالش بدل شده است. لذا میطلبید که قراردادهای این صنعت در قالب و اصول خاصی طراحی شوند تا به بهترین شکل امکان مدیریت ریسک را برای طرفین فراهم آورند. قرارداد ائتلاف پروژه که در ادبیات مهندسی ایران از آن با عنوان تحویل یکپارچه روژه نام برده شده است، در پاسخ به چنین نیازی ابداع شد. چنین رویکرد نوینی از انگلیس آغاز شد و اکنون در برخی کشورها مانند استرالیا بکار میرود. نویسندگان نوشتار حاضر را به بررسی اصول حاکم بر قراردادهای ائتلاف پروژه از منظر استراتژیهای مقابله با ریسک اختصاص داده اند. اصول اصطیادی حاکم بر قراردادهای ائتلاف پروژه از جمله اصل مسئولیت مشترک در نقاط اتصال پروژه، اصل قبول ریسک در نقطه استقلال، اصل تسهیم ضرر و منفعت و غیره نیز ناشی از بررسی نمونه قراردادهای ائتلاف و دستورالعمل ها و مقالات منتشره در این خصوص هستند. حاصل آنکه اجرای دقیق این اصول در روابط میان شرکا امکان مدیریت مطلوب ریسکها را فراهم می آورد، چنانکه پروژه های اجرا شده هم چون پروژه میدان نفتی اندرو این مساله را به اثبات میرساند.Survey the Principles Governing Project Alliancing in Oil and Gas Industry from the Perspective of Risk Confrontation Strategies
One of the major issues of oil and gas industry is risk management that nowadays has been challenged due to necessity for investing in complicated projects. So there has been a need to design a kind of contract with special structure and principles in order to provide the possibility of the best risk management. Project alliancing that in Iran engineering literature named Integrated Project Delivery (IPD) has been created in response to this kind of need and necessity. Such a novel approach has begun from England and nowadays is applied in some other countries such as Australia. So in this article, the Authors have studied the principles governing project alliancing in oil and gas industry from the perspective of risk confrontation strategies. This principles such as several liability in independent points of project, principle of gainshare-painshare and so on, have been discovered from reviewing template of project alliancing contracts, instructions and published articles. As a result the precise performance of these principles in the relationships of participants, provide the possibility of the best risk management such as Andrew Project performed by British Petroleum and its contractors.
